The dispute between NACON and Frogwares has finally ended
Some of you out there might have noticed that the adventure/horror title The Sinking City disappeared from digital storefronts a while back. And, there’s a perfectly valid reason for that; it seems as though developer Frogwares and NACON, the entity in charge of publisher Bigben Games, were locked in a wee bit of a legal dispute. Fortunately (for some people, anyway), the dispute has finally ended, and The Sinking City has once again become purchasable. NACON has released an official press release on the matter, stating the following of the first enforceable decision which was rendered by the Paris Court of Appeal on October 28, 2020:
“The Court ruled that Frogwares had terminated the contract in a ‘manifestly unlawful’ manner and, as a result, ordered, as a ‘precautionary measure, the continuation of the contract (…) until its term or until a decision is made on the breach of this contract and ordered Frogwares Ireland to refrain from any action on the breach of this contract and ordered Frogwares Ireland to refrain from any action that impedes this continuation (…)”.
NACON also commented further, stating the following:
“Confirmed in its expectations by this decisions and regardless of the time needed to resolve this dispute definitively, NACON is continuing its action in defense of its rights and has proceeded with the execution of this court decision by asking platforms and sites to put The Sinking City game back online so that no one is held hostage to this situation. It is however specified that insofar as some of the game’s online stakes depend on the goodwill of Frogwares to perform, their absence cannot be attributed to NACON.”
Personally, I’m pretty clueless when it comes to legal mumbo-jumbo, so I’m not really in a situation to comment on the matter any more than I already have. What about you, though, dear readers?
